NURSING HOME RESIDENTS ABUSED FOR THE ENJOYMENT OF STAFF

Read this recent New York Times story on how employees at some New York state group homes continue to abuse residents despite recent "reforms."

"Some confrontations with staff members turn deadly." One resident "feared she was going to die at her group home near Rochester...she pleaded to be moved out and said she was 'concerned that she will be killed there,' according to a state record of an emergency call she placed. Later that year, she was fatally injured when she was pinned to the floor; two workers pleaded guilty in connection with her death."

Unfortunate, sad and hard to believe, but sexual assault against the elderly in nursing homes occurs. It often is not reported to the police or the family of the loved one. Read CNN's report Sick, Dying and Raped in America's Nursing Homes.

NOVEMBER 1, 2017

State and federal law require that serious cases of abuse in nursing homes be reported to the police. Government investigators say that's not happening.

Serious cases of abuse, enough to send an elder loved one to the emergency room, are not being reported, reveals an August 2017 investigation by the Office of Inspector General in the Department of Health and Human Services.

Shockingly, the majority of the cases reviewed and not reported involved sexual assault.

What are the signs that a loved one in a nursing home might be abused? Here's a fact sheet that might help.

The 10th resident from a Florida nursing home has died as a result of sweltering temperature in that facility after Hurricane Irma. According to a USA Today article, the nursing home had a generator to operate life-saving equipment during the storm, but did not have a generator to take over after an electric transformer powering its air-conditioning was damaged.

Florida officials have suspended the nursing home license of the Rehabilitation Center at Hollywood Hills in the wake of the deaths. The facility is now the subject of a criminal investigation.

NURSING HOME AND RAPE?

THE UNIMAGINABLE DOES HAPPENS

MUCH MORE THAN YOU THINK!

HAS YOUR LOVED ONE BEEN ABUSED OR NEGLECTED BY THE NURSING HOME?

https://www.tlcsr.com/wp-content/uploads/2013/11/Nursing-home.jpg

You trusted the nursing home to take care of a family member or loved one. Now you have learned that through indifference, carelessness or callous disregard, the nursing home has not kept its promise and has injured or even abused the family member or loved one.

UNFORTUNATELY, YOU ARE NOT ALONE!

Many families rely on the service of nursing homes to provide care for their elderly loved ones. Sometimes, a nursing home is the only option. When a person places their elderly family member into a nursing home, they expect to receive the level of care promised. Some nursing homes, however, fail to offer the standard of care promised. It comes as a shock when one finds out that their loved one has been a victim of nursing home injuries or abuse. The abuse and neglect victims and their families have suffered in ways that no individual in our society should suffer.

FIGHT BACK!

You do not have to accept the lame excuses of the nursing home. Your family member or loved one, if injured or abused, may be able to do something about this terrible problem… with your help! They may be entitled to damages. Getting in touch with The Garrow Law Firm at 888-88GARROW (888-884-2776). It's the first step in finding out about your rights and how you can obtain justice.

BUT HOW CAN YOU TELL WHEN YOUR LOVED ONE HAS BEEN ABUSED OR NEGLECTED BY THE NURSING HOME?

It is not always easy to tell when a nursing home resident has become the victim of abuse. They are often emotionally are unwilling to report it or may be in fear of the repercussions of doing so. The nursing home staff may be intimidating them, or your loved one may just be reluctant to reveal the truth. If your loved one is injured while a resident, the nursing home may explain the nasty pressure sore or other sign of neglect as something that "happens to old people at this time in their lives." You should be very suspicious of such explanation.

BE ALERT!

You should be alert to the following signs of potential injury or abuse.

OBVIOUS SIGNS:

Unusual bruising or bleeding Open wounds, sores or cuts Burns and abrasions Sudden and unexplained change in weight Soiling, poor hygiene, smell of urine or feces Infections Loss of hair Torn, stained, or bloody clothing or bedding

LESS OBVIOUS SIGNS:

Listlessness or unresponsiveness Infantile or other strange behaviors Physical or emotional withdrawal Disappearance of personal items Sudden and unusual financial transactions If you note any of these signs, considering doing the following immediately.

MORE RED FLAGS

If you arrive at a facility to visit your loved one during regular visiting hours and the staff refuses or delays access, that's a problem. Be suspicious!

If you arrive at a facility to visit your loved one during regular visiting hours and the staff or a staff member refuses to leave the room during your visit --- refuses to give you private time with your loved one --- that's a problem. Be suspicious! They may be hiding something.

Again, it is important to begin by REGISTERING YOUR CONCERNS WITH THE MANAGEMENT, but if you are not satisfied, YOU HAVE THE LEGAL RIGHT TO FILE A COMPLAINT TO THE APPROPRIATE STATE AGENCY. And of course you can always, and are urged to,
